Privacy Policy

“New Customer”

The main purpose of the processing is the management of registered users on our website. Legitimation: Art. 6.1.a) GDPR: express consent. The data will be kept until the user deletes his or her personal account.

“Place or process an order”

The data will be processed for the purpose of managing your purchase: shipping, collection, after-sales procedures. The basis that legitimizes the processing is the execution of the contractual relationship of sale in accordance with Art. 6.1.b) GDPR. The data may be communicated to the technical departments of the manufacturers when it is necessary to process the guarantee of a product. This communication is legitimized by Art. 6.1.c) GDPR, the processing is necessary to comply with the legal obligation of guarantee stipulated by Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. The data will be kept until the user deletes his or her personal account. Subsequently, they will be kept blocked until the date of prescription of legal actions (for example, legal guarantee of the product or conservation of invoices). After this period, the data will be deleted irreversibly.

In order to process the delivery of your order, the delivery person may request identification data in order to identify you and prevent fraudulent deliveries (such as ID number, name or surname). We inform you that your data will only be processed for this purpose. Under no circumstances will the delivery person be authorized to capture an image of your identification document, nor will they be able to take photographs or videos by any means.

In the event that the collection is carried out by a person other than the person who processed the order, we inform you that the processing of the data is strictly necessary for the prevention of fraud in accordance with Recital 47 of the GDPR, the basis that legitimises the processing is legitimate interest. The data will not be communicated to third parties, nor will it be subject to international transfer. The data will be kept for the period of verification of delivery and will subsequently be duly blocked until the date of prescription of legal actions. After this period, the personal data will be deleted irreversibly. Likewise, we inform you that the image of your identity document can never be captured by the delivery person.

“Newsletter and advertising delivery”

When the user has not previously made a purchase at ATELPO, he/she will only be sent advertising related to ATELPO's own products and services when he/she gives his/her express consent for this purpose. The legitimising basis is express consent in accordance with Art. 6.1.a) GDPR. The data will be kept until the user expresses his/her opposition to the processing by means of a simple and accessible unsubscribe procedure in each advertising communication.

People who have made purchases of products sold by ATELPO may receive commercial communications based on Art. 21.2 of Law 34/2002, of July 11, on information society services and electronic commerce. The interested party may easily unsubscribe through the link available in each communication.

“Contact Form”

The data will be processed to process a request for information. The legitimate basis for processing is Art. 6.1.a) GDPR, the express consent of the interested party. The data will only be kept for the period necessary to process the query.

“Repair request form”

The data will be processed to issue a quote and manage the repair request. The legal basis for the processing is Art. 6.1.a) GDPR, the consent of the interested party. If the client accepts the repair quote, the legal basis will be Art. 6.1.c) GDPR, execution of a contractual relationship. The data will be kept for as long as necessary to provide the service. Subsequently, the data will be duly blocked during the limitation period for any actions that may arise and, after this period, its complete elimination.

Recipients of the data

Due to the purchase, your data may be communicated to the following recipients:

• Banking entities for payment of purchases by card and/or purchase financing studies and obtaining consumer credit. The basis that legitimizes the communication is Art. 6.1.b) execution of the contractual relationship.
• Entities that provide fraud investigation, detection and prevention services, as well as the minimisation of the risk of fraud being committed, based on the legitimate interest recognised by current regulations. The legitimising basis for the transfer is Art. 6.1.c) legal obligation.
• Entities and companies in the energy sector. The legal basis for the transfer is Art. 6.1.c) legal obligation.
• To the Consumer and User Office in the event of any claim. The legal basis for the transfer is Art. 6.1.c) legal obligation.
• To manufacturers, technical services and/or wholesalers in the case of guarantees or repairs. To those transport companies that may be in charge of sending the corresponding orders to customers.
